State Title Agency will:
  • Act as the responsible party for the filing with the Department of Real Estate (DRE). We will prepare much of the necessary documentation for submittal to the DRE for the Public Report, including the DRE application, sample Deed, and Title Requirements. State Title Agency, Inc. will act as the liaison between you and the State until the Public Report is issued.
  • File "The Request To Do Lot Reservations" and/or "The Petition for Conditional Sales Exemption."
  • Assist the Engineer/Surveyor with title questions and problems during the map process.
  • Assist in obtaining necessary Lender consents and signatures on the map. We will issue the Subdivision Title Report to the county/city, if required.
  • Review all maps, condo plans, CC&R's etcedera to see that they are consistent with one another and meet the necessary requirements for the DRE and Title insurance purposes.
  • Do everything necessary to assure a timely issuance of the Public Report and a smooth transition to the Escrow office closing your sales.
Provided Documents
  • PREPARATION OF APPLICATION: We will type and assist in the completion of the application.
  • PRELIMINARY TITLE REPORT: State Title Agency Inc. will provide a title report and supporting documentation to the Department of Real Estate (DRE).
  • RECORDED SUBDIVISION MAP: We will provide a copy that meets the requirements of the DRE.
  • SAMPLE DEED: We will provide a sample Deed as required to the DRE.
  • CONTRACT DISCLOSURES: That are required to be attached to the Sales Contract
  • A LEGIBLE COPY OF RECORDED DOCUMENTS: We will provide copies of any documents that are recorded as shown on the Preliminary Title Report.
  • COPY OF THE CC&R's: If the project should record CC&R's we will make a copy of them.
  • PREPARATION OF LETTER REGARDING PERMANENT ACCESS: We will prepare the necessary letter as required by the DRE.
  • FLOOD LETTER: We will request from the Engineer the flood zone designation letter required by the DRE.
  • FINANCIAL DOCUMENTS: If needed we will coordinate with the Lender and or the County for the Development Project the documents required by the DRE.
  • FINANCIAL RELEASES: If there will be a Development Loan we will acquire the necessary documents from the Lender as the terms of the Partial Releases for each lot.
  • ENGINEERS COST BREAKDOWN: We will contact the Engineer for a cost breakdown of the Development improvements if said improvements are not finished by the time that the application is submitted.
PUBLIC REPORT FORMAT: We will type the actual Public Report and submit it to the State on diskette along with one hard copy.
Required Documents
Standard Subdivisions:
  • FILING FEE: The filing fee is remitted by a check made payable to the Department of Real Estate (DRE) for a standard subdivision, the amount is $500.00.
  • SAMPLE CONTRACT TO PURCHASE: A copy of whatever Contract will be used for the sale of the lots.
  • CC&R's: If there will be Covenants, Conditions and Restrictions, or a joint use and maintenance please provide a copy as soon as they become available. We will record.
  • DOCUMENTS AUTHORIZING THE SIGNATORY: Authorization for any individual(s) signing on behalf of a Corporation, Limited Liability Company, Partnership, Trusts or Owners (Corporate resolution, Partnership agreement, Operating agreement, Trust agreements etc.) authorizing the signing of documents and correspondence related to this application.
  • COPIES OF ANY DOCUMENTS FOR THE HOMEOWNERS ASSOCIATION: If there is to be any type of a Homeowners Association we will need a copy of the Articles of Incorporation and Bylaws for the Association.
  • ADEQ REQUIREMENTS: A copy of the Arizona Department of Environmental Quality (ADEQ) approval of the project.
  • WATER/SEWER DOCUMENTS: We will need a copy of a letter showing that the services are being provided as to the requirements of the DRE.
  • CONDOMINUM PROJECT: Copies of all documents creating the condominium and an attorney's opinion letter as to the requirements of the DRE.
  • FINAL PLAT FOR RECORDING: If at all possible, we would like to take the final plat to the County for Recording.
  • SIGNATURES ARE REQUIRED: There are various places in the Application that require signatures. We will provide the pages.
FINANCIAL ASSURANCES: Documents required by the DRE regarding the financing of the amenities being provided in the Subdivision (i.e. Roads, Sewer, Water, etc...)
